Terms and Conditions

Thank you for choosing the bank debit card load service (the "Service") to add funds to your reloadable prepaid card. The following terms incorporate and supplement the terms of your Cardholder Agreement with Green Dot Bank, and any references to "we", "us", and "our" in these terms have the same meaning as in your Cardholder Agreement. In the event of any inconsistency between these terms and conditions and any provision of your Cardholder Agreement, these terms and conditions control with respect to the Service, but only to the extent necessary to resolve the inconsistency. By using the Service, you are agreeing to these terms. Please review them carefully and print a copy for your records.
- Your Representations. You represent and warrant to us that: (a) you are at least eighteen (18) years old; (b) the personal information that you provide to us in connection with the Service is true, correct and complete; (c) you are the owner of the debit card identified in your registration for the Service and any related bank account (the "debit card"); (d) you are the owner of the prepaid card; and (e) you are authorized to use the debit card to add funds to your prepaid card.
- Confirming Your Identity. You authorize us and our agents to confirm your identity with consumer reporting agencies, credit reporting agencies and others. This may include asking you for additional information or requiring you to take additional steps to confirm information you have already provided.
- Use of Personal Information. During the registration and funding process for the Service, you will be providing certain personal information, such as your name, address, telephone number and bank debit card number to both Green Dot Corporation and us. We may share your personal information with service providers so that we can provide you with the Service and to comply with applicable law.
- Necessary Equipment. In order to use the Service, you will need access to the Internet and a supported browser (e.g., Internet Explorer version 6.0 or above and Firefox version 2.0 or above).
- Your Debit Card. To use this Service, your debit card must have been issued by a licensed U.S. bank and be accepted on the Visa or MasterCard network (check the card for the appropriate logo). Please note that the amounts you add to the prepaid card plus any applicable fees may be charged almost immediately to your bank account. The types of debit cards that can be accepted for the Service are subject to change.
- Available Funds. You are responsible for ensuring that your debit card has sufficient available funds (including associated fees) for each load you request. If you do not have sufficient available funds, your financial institution may not authorize the transaction. We have no control over your financial institution’s decision. We also are not responsible or liable to you for any insufficient funds fees or other fees imposed by your financial institution or any transactions that you are unable to complete if you fail to have sufficient funds for your load request. Please note that it may take up to one hour to process a load request if you are applying for a temporary card online at the time of your load request.
- Updating Your Information. You agree to notify us promptly of any change in your name, address, email address, phone number, or the ownership or expiration date of your debit card.
- Minimum and Maximum Load Amount; Limitations. You can use the Service to load $20 - $200 to your prepaid card at one time. We may limit the number of transactions you can make using the Service with your temporary card. The minimum and maximum load amounts are subject to change. Please review your Cardholder Agreement for other funding limits on your prepaid card.
- Bank Debit Card Test Transaction. You agree to a one-time debit card test transaction when you register your debit card for the Service. The test transaction will be in a random amount (less than $1.00) that you must confirm back to us. The amount will be credited to your prepaid card after you successfully complete the Service registration process. If you do not confirm the test transaction and complete your registration within 10 days of the test transaction, we will refund the test transaction amount to the debit card.
- Service Fees. We charge a service fee of $2.95 each time you use the Service to add funds to your prepaid card. The fee will be added to the amount you choose to load and will be charged to the debit card you use to add funds. The fee is in addition to the funds you choose to load onto the prepaid card, any fees charged by the issuer of your debit card or your bank, fees charged by the merchant where the prepaid card is used, and the one-time test transaction amount to register your debit card as described above. You are responsible for any and all taxes which may apply to your use of this Service, the receipt of funds on your prepaid card, and your use of the prepaid card.
- No Refunds. Once you add funds to your prepaid card from your debit card, you cannot transfer funds back to your debit card from your prepaid card.
Hours of Operation/Availability. You can access this Service 7 days a week, 24 hours a day. There may be times, however, when all or part of the Service is unavailable due to system outages or maintenance. We assume no responsibility for any damage or delay that may result from such unavailability.
THIS SERVICE IS MADE AVAILABLE ON AN "AS-IS" AND "AS AVAILABLE" BASIS. NEITHER WE NOR OUR AGENTS OR VENDORS PROVIDE ANY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE SERVICE. ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED TO THE GREATEST EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE, CONTINUOUSLY AVAILABLE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
UNLESS OTHERWISE REQUIRED BY LAW, NEITHER WE NOR OUR AGENTS OR VENDORS SHALL BE LIABLE FOR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, LOSS OF OR DAMAGE TO PROPERTY OR CLAIMS OF THIRD PARTIES, EVEN IF WE HAVE BEEN ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES.
Some states do not allow the exclusion or limitation of certain types of damages or implied warranties. As such, the disclaimers above may not apply to you.
- Indemnification. You agree to indemnify us and our agents from all claims, liabilities, losses, expenses and damages, including attorney’s fees, arising out of any action we take pursuant to your instructions or your violation of these terms or applicable law.
- Severability. If any provision of these terms is deemed invalid, unlawful, void, unenforceable, or declared invalid by order of court or regulatory authority, the remaining terms shall not be affected, and these terms shall be interpreted as if the invalid terms had not been included in these terms.
- Governing Law/Jurisdiction. These terms will be governed by and interpreted in accordance with Federal law and, to the extent Federal law does not apply, by the laws of the State of Utah. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Salt Lake City, Utah with respect to all controversies arising out of or in connection with the use of the Service. Note: If our records reflect that the owner of the prepaid card is a resident of Illinois, the laws of the State of Illinois, rather than Utah, shall apply to the extent Federal law does not apply.
- Amendment. We may add to, delete, or change these terms at any time by sending a notice to you at the address or e-mail address shown in our records, by posting the notice or an amended agreement on our website, or by delivering it to you. Unless we notify you otherwise, an updated version of these terms will be effective when we post it on this website. The last time these terms were modified is shown at the top of this document.
- Termination. We may suspend or terminate your access to or use of the Service at any time without cause. We may immediately suspend your use of the Service if you breach this or any other agreement with us, we have reason to believe there has been or may be an unauthorized use of your prepaid card, or we are unable to verify your identity or authority to use the debit card to our satisfaction.
